Terms and Conditions

1. general

 

1.1 These terms and conditions contain the exclusive terms and conditions applicable between us, Eazy Recruiting GmbH, Frahmredder 92a, 22393 Hamburg, Germany (hereinafter "Seller" or "we") and a consumer or entrepreneur (hereinafter "Customer") for the purchase of the following offered goods and services "Germany Career Coaching", "CV Review", "LinkedIn & Xing Review" and "Interview Coaching", insofar as these are not amended by written agreements between the parties.

 

For the purposes of these terms and conditions, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession. An entrepreneur within the meaning of these terms and conditions is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

 

1.2 The customer shall be notified of changes to these terms and conditions in writing, by fax or by e-mail. If the customer does not object to this amendment within four weeks of receipt of the notification, the amendments shall be deemed to have been accepted by the customer.

 

2 Conclusion of contract

 

2.1 The presentation of the goods and services offered does not constitute a binding offer by the seller. Only the ordering of goods through the booking of the respective service by the customer constitutes a binding offer according to § 145 BGB. In the event of acceptance of the purchase offer by the seller, the seller shall send the customer an order confirmation and an invoice by e-mail.

 

2.2 After submission of the offer and successful completion of the order and payment, the customer receives a purchase confirmation by e-mail with the relevant data. The customer shall ensure that the e-mail address entered by him is correct.

 

2.3 During the ordering process, the customer has the opportunity to correct the entries made.

 

2.4 The contract is concluded in German.

 

2.5 The customer shall be contacted by the seller by e-mail.

 

2.6 In the case of digital goods, the seller grants the customer a non-exclusive right, unlimited in time and place, to use the digital content provided for private and business purposes. The content may not be passed on to third parties or reproduced for third parties unless permission has been granted by the seller.

 

2.7 As soon as the customer has booked, the customer will receive a confirmation e-mail. The online coaching session [Germany Career Coaching or Interview Coaching] will take place at the time the customer has booked in the service area of this website. If he/she needs to postpone the appointment, the customer can do so at any time up to the start of the agreed appointment by sending an email to info@eazyrecruiting.de. The client meets the seller live via online meeting and the format is discussion based or depending on the topic the client wants to cover.

 

Following the online meeting, the customer has the opportunity to send the salesperson an email with questions.

 

If the customer does not show up within the first 15 minutes of the online meeting, the session will be canceled and there will be no refund or rebooking. In this case, the seller is also no longer required to provide the remaining components of the service booked in connection with the online meeting, as these are based on the online meeting. 

 

2.8 Description and content of the various services:

 

*Germany Career Coaching:

90-minute online meeting to develop an applicant strategy and for general questions (no advice on visa processes)

Introduction to at least 10 potential employers (less if employment is found beforehand).

CV screening, LinkedIn and Xing screening

 

*Interview coaching or mentoring session

Answers to general questions (no advice on visa processes)

Targeted coaching to prepare for job interviews incl. role plays and preparation for typical interview questions

 

*CV Review

60 minutes online meeting 

Optimization suggestions for the CV according to European standards

 

*LinkedIn & Xing Review

60 minutes online meeting

Optimization suggestions for the LinkedIn or Xing profile according to European standards including advice on increasing findability through keyword optimization 

 

 

3. terms of payment

 

3.1 The purchase price is due immediately upon ordering. Payment for the goods shall be made using the payment methods provided on the website.

 

3.2 The prices stated at the time of the order shall apply. The prices stated in the price information include statutory VAT.

 

3.3 The customer may only offset claims of the seller against undisputed or legally established counterclaims or counterclaims that are ready for decision.

 

4. shipping conditions

 

4.1 The ordered goods shall be shipped in accordance with the agreements made. Any shipping costs incurred are listed in the product description and are shown separately on the invoice.

 

4.2 Digital goods are made available to the customer in electronic form either as a download or by e-mail.

 

5. right of withdrawal

If a customer acts as a consumer according to §13 BGB, he is entitled to a statutory right of withdrawal. If a customer acts as an entrepreneur in accordance with §14 BGB in the exercise of his commercial or independent professional activity, he has no statutory right of withdrawal. Further information on the right of revocation can be found in the revocation instructions on the payment page of the product.

 

6 Offline events

If the customer purchases a ticket for an offline event, the following provisions apply:

In the event of compelling organizational or economic reasons for which the organizer is not responsible, the organizer reserves the right to cancel an event. In this case, the organizer will inform the customer immediately and rebook the tickets for a subsequent event. Cancellation costs against which the participant could have insured himself (ticket insurance, travel cancellation insurance, etc.) will not be reimbursed under any circumstances.

 

In the event of force majeure or official cancellation of the event, liability on the part of the organizer is excluded.

Liability for cancellation or rebooking fees for means of transportation or accommodation booked by the customer is excluded.

 

7 Warranty 

If the delivered goods are defective, the customer is entitled within the framework of the statutory provisions to demand subsequent performance, to withdraw from the contract or to terminate the contract, to reduce the purchase price, to demand compensation for damages or the reimbursement of futile expenses. Defects notified prior to purchase do not constitute a warranty case. The limitation period for warranty claims for the delivered goods is two years from receipt of the goods.

 

8. limitation of liability and exclusion of liability / Disclaimer

 

8.1 The seller is liable for intent and gross negligence. Furthermore, the seller shall be liable for the negligent breach of obligations, the fulfillment of which is essential for the proper execution of the contract, the breach of which jeopardizes the achievement of the purpose of the contract and on the observance of which a customer regularly relies. In the latter case, however, the seller shall only be liable for foreseeable damage typical of the contract. The seller is not liable for the slightly negligent breach of obligations other than those mentioned in the preceding sentences.

 

8.2 The above exclusions of liability shall not apply in the event of injury to life, limb or health. Liability under the Product Liability Act remains unaffected.

 

8.3 According to the current state of technology, data communication via the Internet cannot be guaranteed to be error-free and/or available at all times. In this respect, the seller is not liable for the constant and uninterrupted availability of the online trading system and the online offers.

 

8.4 The information provided by the Seller on this website, in online coaching sessions and by e-mail is for information purposes only. The views and opinions expressed on this website are expressly those of the seller, derived from the experience of founder Marie-Luise Schiller. Everything on this website is the personal opinion of the seller, not licensed advice. It is important for the customer to note that each individual's needs are unique and there is no "one size fits all".

 

This website is for general information purposes only. Nothing on this website should be construed as advice for any particular person, case or situation. 8.5 The European Commission provides a platform for online dispute resolution (ODR), which you can find at http://ec.europa.eu/consumers/odr. We do not participate in dispute resolution proceedings before a consumer arbitration board.

 

9. final provisions

 

9.1 Amendments or additions to these terms and conditions must be made in writing. This also applies to the waiver of this written form requirement.

 

9.2 The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. Mandatory provisions of the country in which a consumer has his habitual residence shall remain unaffected.

 

9.3 If a consumer had his domicile or habitual residence in Germany when the contract was concluded and has either relocated at the time the action is brought or his place of residence is unknown at that time, the place of jurisdiction for all disputes shall be the seller's place of business.

If a consumer does not have his domicile or habitual residence in a member state of the European Union, the courts at the seller's place of business shall have exclusive jurisdiction for all disputes.

 

If the customer acts as a merchant, a legal entity under public law or a special fund under public law with its registered office in the territory of the Federal Republic of Germany, the exclusive place of jurisdiction for all disputes arising from this contract shall be the place of business of the seller.

 

 

9.4 Should individual provisions of this contract be invalid or contradict the statutory provisions, this shall not affect the remainder of the contract. The invalid provision shall be replaced by the contracting parties by mutual agreement by a legally valid provision which comes closest to the economic sense and purpose of the invalid provision. The above provision shall apply accordingly in the event of loopholes.
